1. Services

HeyJob AI, Inc. (“Company”) provides “HeyJob,” an AI-powered interview and recruitment support platform for business users (the “Service”), which includes the following features:

  • AI-based analysis of applicant responses and generation of evaluation reports
  • Collection, storage, and management of applicant video, audio, and response data
  • Tools to manage and support recruitment and hiring processes
  • Automation features designed to improve hiring efficiency

2. Eligibility and Activation

Use of the Service begins once the customer completes the Company’s required registration process and the Company approves such registration.

3. Fees and Payment

  • Customers shall pay all applicable subscription fees on a monthly or annual basis in accordance with the selected plan.
  • Failure to pay fees when due may result in suspension or termination of the Service, in whole or in part, without prior notice.

4. Data Processing and Use

  • Applicant-related recordings, audio, responses, and related data (“Applicant Data”) are processed by the Company solely as a service provider and data processor, in accordance with the customer’s instructions.
  • The Company may use anonymized and aggregated data, which cannot reasonably be used to identify individuals, for service improvement and product development purposes.
  • Upon termination of the Service, Applicant Data will be deleted or retained in accordance with applicable law and contractual obligations.

5. Use of Artificial Intelligence

  • AI-generated outputs are provided for decision-support purposes only and do not constitute hiring decisions. All final employment decisions remain the sole responsibility of the customer.
  • Customers shall not use the Service or AI outputs in a manner that is unlawful, discriminatory, or inconsistent with applicable employment laws.

6. Prohibited Conduct

Customers shall not:

  • Use the Service in violation of any applicable law or regulation
  • Share accounts or grant unauthorized access to third parties
  • Reverse engineer, decompile, or otherwise attempt to derive the source code or underlying systems of the Service
  • Interfere with or disrupt the operation of the Service, including by imposing unreasonable or excessive load

7. Customer Information

All non-public business information provided by customers, including hiring requirements and job-related information, shall be treated as confidential and handled in accordance with the Company’s confidentiality obligations.

8. Confidentiality

  • Each party agrees to maintain the confidentiality of any non-public information obtained in connection with the Service and not to disclose such information to third parties.
  • Confidentiality obligations shall survive termination of the Service for a period of three (3) years.

9. Disclaimers and Limitation of Liability

  • The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
  • To the maximum extent permitted by law, the Company’s total liability arising out of or related to the Service shall not exceed the total fees paid by the customer for the Service during the three (3) months immediately preceding the event giving rise to the claim.

10. Governing Law and Venue

  • These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law principles.
  • Any legal action or proceeding arising out of or relating to the Service shall be brought exclusively in the courts having jurisdiction over the Company’s principal place of business, and the parties hereby consent to such jurisdiction and venue.
